
NEC in New Zealand
The NEC is being increasingly used throughout the Australasian region - particularly in New Zealand. A number of New Zealand clients have recently or are currently undertaking projects using one or more of the NEC suite of contracts. Clients include local authorities, utility companies and private sector companies. The NEC has been drafted for international use, and thus provides an alternative to existing commonly used forms of construction contract in New Zealand, (more specifically as an alternative to NZS3910).
In particular, the NEC is being used to facilitate early contractor involvement and some of the more innovative forms of procurement, including pain / gain share arrangements between the parties using NEC3 Engineering and Construction Contract Options C and D. The Term Service Contract (TSC) is also being used in New Zealand for facilities management contracts. We also have Meridian Energy as one of the first users of the NEC3 Supply Contract.
There are only a few minor additional clauses required for the NEC Engineering and Construction Contract (ECC) to address the requirements of the Construction Contracts Act (2002) (CCA). NEC have published a set of New Zealand clauses addressing these requirements in the form of Y(NZ)1, free to download here .

NEC Australasia Users' Group
In July 2011 the new NEC Australasia Users' Group was launched covering Australia, New Zealand, Antarctica and adjacent Pacific Ocean Islands to reflect growing usage of NEC3 contracts in the region. The Users' Group is chaired by Warwick Fergusson of Meridian Energy, a major long-term user of NEC contracts in the region.
The NEC Australasia Users' Group has been established to service NEC3 users in their region more effectively, allowing us to be more responsive within your market context and time-zone. Members of the group get access to local forums and are able to share information, knowledge and skills to get the very best out of the NEC3 contracts. There is also a regular series of workshops and conferences. This new regional group structure ensures that all events will be focused on issues pertaining to the local market.
Members of the Australasia Users' Group will also receive a complete set of NEC3 contracts and documents, plus a copy of all new documents when they are published.
