This one-day course introduces delegates to the philosophy of the NEC family of contracts and focuses on the provisions of the NEC3 Engineering and Construction Contract (ECC).
The delegates will gain an understanding of the key aspects of ECC including the responsibilities of the Parties; the Option structure including the use of key performance indicators and multi-party partnering; provisions for time and programme; testing and Defects; payment; compensation events; risk and insurance; dispute avoidance and the contribution of the ECC to the effective management of a project to achieve the project objectives using a collaborative approach.
Objectives
By the end of the course, delegates should:
- Understand the philosophy of NEC
- Develop skills to advise on development of appropriate contract strategies
- Appreciate the use of Contract Data, Works Information and Site Information
- Understand roles and responsibilities of key parties
- Understand the important ECC clauses and processes, in particular early warning, the programme, Risk Register, communications and compensation events
- Understand how to apply ECC in practice and achieve satisfactory solutions to problems

A one-day course for everyone working with the NEC3 ECC including project managers, contract managers, quantity surveyors, planners, clients, consultants, contractors and their supply chain.
Outline Programme
- Background and underlying principles - the concept
Deals with generic NEC characteristics, the NEC family of contracts and typical ECC arrangements
- The ECC system and contract strategy - the Options
Covers when the ECC should be used, an explanation of the main and secondary Options that can be chosen, and the other contract documents that need to be produced.
- General provisions and Contractor's main responsibilities
General provisions covers the general techniques that are used to manage the contract including mutual trust and co-operation, identified and defined terms, communications, the role of the Project Manager and Supervisor, and early warnings.
Contractor's main responsibilities covers how the works are defined, the Contractor's design, key people, Key Dates and subcontracting.
- Time, testing and Defects
Details when the works start and finish, the use of the programme, and how defective work is managed.
- Payment
Covers how the amounts for payments are calculated and when those payments are made.
- Compensation events
Explains what compensation events are and how they are managed.
- Other aspects of the ECC
Details title, risks and insurances, termination and dispute resolution
- Summary and open forum
