This full day workshop is composed of two different sessions:
  • Morning session: NEC4 ECC: Key changes affecting the management of the contract
  • Afternoon session:  NEC4: Evolution of the Service Contracts

NEC4 ECC: Key changes affecting the management of the contract 
The morning session is designed to help project managers, contractors and supervisors identify and understand key changes under NEC4.  We start with updates to defined and identified terms and other general matters.  We will then cover various changes and simplifications to programme, payment and compensation events (many driven by industry feedback), before exploring some new process and initiatives.

NEC4: Evolution of the Service Contracts 
The afternoon takes a look at how consistency has been achieved over the TSC and PSC contracts.  We will cover the introduction of people rates, cost components and the overhaul of the Task Order mechanism.  We will explore the various new secondary options and how work is ordered in practice.  Both sessions will afford the opportunity for delegates to ask questions and explore the detail behind the clauses. An overview of NEC4’s guidance notes will also be provided.

Peter Clayton, Partner, Pinsent Masons
Peter is a partner in Pinsent Masons' Construction team.  He lives and works in Hong Kong.  He has extensive experience of advising and representing clients on NEC contracts both in Hong Kong and in the UK including advising the Hong Kong Government on preparation of contract documents for two pilot NEC PSC projects.
Peter has also acted on a number of disputes and adjudications arising on NEC contracts in the UK where he worked for Pinsent Masons for 16 years prior to transferring to Hong Kong. Peter also advised and represented a contractor on its successful tender for a major framework contract for the 2012 Olympics.
Peter's transactional and dispute resolution experience extends well beyond the NEC form.  He has extensive experience of traditional dispute resolution procedures such as arbitration and mediation on traditional contracts but has also advised the Hong Kong Government on the planned introduction of security of payment legislation which will introduce improved payment practices and provide a right for disputes to be resolved by adjudication.
Peter regularly lectures on a variety of construction related topics including providing training on the NEC to a variety of clients and institutions.  He is a Fellow of the Chartered Institution of Civil Engineering Surveyors in Hong Kong.
Robert Gerrard, NEC Consultant
Robert specialises in NEC contracts, both setting these up and successfully managing them. He has over 30 years’ experience in contract management and carries out training around the world. Robert is also an Accredited Mediator.
He is an Examiner for the ICE Certificate in Law and Contract Management (CLCM) and has also held the position of NEC Users’ Group Secretary from 2006 to date.
His publications include NEC2 and NEC3 Compared, 2005, joint author in NEC3 Practical Solutions, was an NEC4 Contract Drafter and part of the NEC3 contracts working group.
