NEC4: Dispute Resolution Service Contract
The NEC4 Dispute Resolution Service Contract (DRSC) is for parties to NEC4 contracts to jointly appoint an adjudicator, or members of a dispute avoidance board, to resolve a contractual dispute. It can also be used for appointing a dispute resolver under other forms of contract.
The DRSC is a cost-reimbursable contract, with the dispute resolver’s fees and expenses paid equally by the parties. The document includes everything needed to prepare, tender and manage an NEC4 DRSC, including specific clauses for adjudications and dispute avoidance boards, and a form for the contract data.
Background
The DRSC is part of the NEC4 suite of collaborative, flexible and clearly written contracts for built environment procurement. The suite has a global track record for delivering all kinds and sizes of building and infrastructure projects on time, on budget and to the highest environmental and quality standards.
Most NEC4 contracts provide for initial resolution of disputes with an adjudicator appointed under a DRSC. The main works contracts also offer the use of a dispute avoidance board of up to three members, each appointed using a DRSC.
