If the Supplier does not notify a compensation event within eight weeks are they time bared?
Clause 61.3 requires the Supplier to notify compensation events within eight weeks of becoming aware. Yes, failure to do so would result in them losing entitlement. However, if it resulted from the Supply Manager giving an instruction, changing an earlier decision or correcting an assumption then it would not be (see clause 61.3)
