We are the project manager on an NEC3 ECC building project. The employer is using part of the building prior to completion to suit the contractor’s method of working. Do we need to issue a take-over certificate?
If the employer is using a part of the works prior to completion solely to suit the contractor’s method of working, then the employer has not taken over that part of the works (see the exception in the 2nd sentence of clause 35.2). This means that no take-over certificate should be issued because take over has not occurred.
