We have recently received an Adjudicator’s decision but are not happy with it – can we refer it back for a further adjudication?
No, once a dispute has been adjudicated upon it can either be accepted or referred to the tribunal named in the contract. Both Parties could resolve this by arriving at their own agreement and recording this e.g. clause 12.3 of the NEC3 Engineering and Construction Contract (ECC3).
