NEC users are reminded to comply with the copyright policy statement published within the NEC printed documents, which states:

"All rights, including translation, reserved. The owner of this document may reproduce the Contract Data for the purpose of obtaining tenders, awarding and administering contracts. Except as permitted by the Copyright, Designs and Patents Act 1988, no part of this publication may be otherwise reproduced, stored in a retrieval system or transmitted in any form or by any means, electronic, mechanical, photocopying, recording or otherwise, without the prior written permission of the NEC Director, Thomas Telford Ltd, One Great George Street, Westminster, London SW1P 3AA."

Deliberate infringement of copyright on a commercial scale may result in legal action.

A copyright licence should be taken for the use of NEC contract documents if the user wishes to:

  • amend the wording of the standard published contract documents
  • store part or full contract(s) documents in any word-processing system or electronic system
  • reproduce both printed and electronic copies of the contract(s) and associated documents.

Organisations that have a copyright licence agreement with Thomas Telford Ltd have an obligation under the licence agreement to ensure the changes to standard NEC contracts are clearly marked and made available to tenderers/suppliers.
