This half-day workshop will explore the topic on ‘Carrots and sticks in contracts’ and ‘Defects, Completion and take over.’
Presentation 1
Mohammed Talib will discuss the concept that most construction contracts are set up to punish failure and in turn we are seeing many businesses and project failures in the industry. He will then look at a series of measures to reward things like delivering value, building partnerships, encouraging innovation and technology, and rewarding sustainable and green building methods, and also showcasing how these can be delivered using the NEC.
Presentation 2
Robert Gerrard will discuss the meaning and interaction of the defined terms ‘Defect’ and ‘Completion’ as well as the process of ‘take over’. What is the definition of a Defect and Completion? How do they happen and who does what? What does the take over mean and what are the implications? How do these all relate to one another? The focus of the talk will be the NEC4 Engineering and Construction Contract (ECC).

Robert Gerrard, Senior NEC Consultant, NEC Contracts
Robert specialises in NEC contracts, both setting these up and successfully managing them. He has over 40 years’ experience in contract management and carries out training and consultancy around the world. Robert is based in Hong Kong. He is an examiner for the Institution of Civil Engineers Certificate in Law and Contract Management course and has also held the position of NEC Users’ Group Secretary from 2006 to date.
Robert’s publications include NEC3 and NEC4 Compared (2017), NEC2 and NEC3 Compared (2005), joint author in NEC4 Avoiding and Resolving Disputes (2019), NEC4 Practical Solutions (2017) and NEC3 Practical Solutions (2015).
Mohammed Talib, Partner, Pinsent Masons
Mohammed is a Partner with Pinsent Masons specialising in construction law, competition law in the infrastructure sector and international arbitration. His practice focuses on the contentious aspects of projects, acting for employers, main contractors and sub-contractors in arbitration and litigation on building and civil engineering projects.
Mohammed is also recognised as a market leader for construction, having been recognized by Who’s Who Legal as a Future Leader in Construction in Hong Kong and as a Next Generation Partner - Hong Kong: Construction in Legal 500 Asia-Pacific. He is also listed in the 2023 Legal 500 Arbitration Powerlist – Hong Kong Region.
