This half-day workshop will explore the topic on ‘Carrots and sticks in contracts’ and ‘Defects, Completion and take over.’
Presentation 1
Mohammed Talib will discuss the concept that most construction contracts are set up to punish failure and in turn we are seeing many businesses and project failures in the industry. He will then look at a series of measures to reward things like delivering value, building partnerships, encouraging innovation and technology, and rewarding sustainable and green building methods, and also showcasing how these can be delivered using the NEC.
Presentation 2
Robert Gerrard will discuss the meaning and interaction of the defined terms ‘Defect’ and ‘Completion’ as well as the process of ‘take over’. What is the definition of a Defect and Completion? How do they happen and who does what? What does the take over mean and what are the implications? How do these all relate to one another? The focus of the talk will be the NEC4 Engineering and Construction Contract (ECC).
