As the client, must we include a guaranteed maximum price in an NEC3 ECC Option C contract?
No, the share of pain or gain and whether either is capped or not, is entirely down to the parties to agree via the contractor’s share at tender stage. Complete flexibility is offered in the ECC for this and the answer is the same when using NEC3 or NEC4 contracts.
